Fails to mention scams and irregularities in report!

Ironic is the word that comes to mind when we look at the report published recently by Bangladesh Bank (BB) titled “Role of Bangladesh Bank in the govt success for the last 10 years.” That BB has managed to completely ignore mentioning the repeated scams, the central bank heist and failure to rein in the culture of financial misconduct by bank managements, is quite an eye-opener. To the uninitiated reader, the report will come across as one of glorious success! Not only is this report misleading but is also unethical because by definition, the central bank is an autonomous body and by that count alone, it shouldn't be partaking in any form of electoral campaign on behalf of the government.

The reality is that the BB has not been allowed to play its function fully over the last decade; rather it served a subservient role under the ministry of finance. When the financial scams hit the state-owned commercial banks, it was expected that BB would play a strong role in stamping out the irregularities. That never happened. 

Not only that, the central bank went along with policy decisions taken elsewhere and complied with the amendment to the Bank Company Act that allowed for four members of the same family to sit on the board of a private bank. This decision and indecision in other matters have, according to banking sector experts, weakened the financial sector considerably. Today, the sector is mired in controversy and that BB chose to wilfully ignore mentioning all irregularities in the self-laudatory report has undermined the autonomous role that the central bank should have played.

EC must prioritise earning people’s trust, not EVM

AMID widespread opposition to the use of electronic voting machine in the upcoming national election, the Election Commission decided to use it in six constituencies. Addressing a press conference on Sunday, as reported in New Age on Monday, the secretary of the commission confirmed that they will use EVM in 900 hundred polling centres of these randomly selected constituencies. The official also said that the commission so far has 1000 EVMs whereas it requires another 6,500 EVMs imported in a very short time and they have trained only 600 hundred people to operate the machines. 

The commission also allowed assistant presiding officials to use their fingerprints at 25 per cent of total votes of a centre to assist the voters, if the thumbs of any voters did not match. Globally, the introduction of electronic voting involved a prolonged process of trials of the system to ensure that the system is effective and voters are familiar with the technique and technology. In a country like Bangladesh with low levels of digital literacy, the logistical challenges alone can deprive citizens of their right to franchise. Clearly, the technological infrastructure and trained human resources that is required to introduce electronic voting does not exist at the moment. In this context, the decision to use EVM instead of gaining people’s trust will in effect raise further questions about the commission that is already mired with controversy.

From the very beginning, all stakeholders have vehemently opposed the idea of using electronic voting in the next election. In 2017, during the dialogue with the commission, 35 of the 40 registered parties including the main opposition BNP opposed the use of EVM. In fact, there is opposition within the commission itself. Even the prime minister opined that there should not be any rush in this regard. Apart from the political opposition, there is the issue of making the voters familiar with this system, most of whom, it must be admitted, are not familiar with the technology or the idea of voting in this manner. To deal with this problem, the commission have authorised assistant presiding officials to use their fingerprints at 25 per cent of total votes of a centre to assist the voters. It is unclear, how the commission will ensure that the authorised officials in the name of assisting voters would not interfere with their voting decisions. In what follows, the allegation that the commission’s decision to introduce EVM without meeting logistical and reaching a public consensus is to justify a huge expenditure of Tk 3,515 crore budget that has already been allocated for the procurement of 1.5 lakh EVMs and other necessary equipments.

Given the prevailing mistrust among political parties, there is a risk that introducing a new system may further erode the confidence of the voters in the electoral system. The commission, under the circumstances, must reconsider its decision and focus on addressing the grievances and questions raised about its role in administering a free, fare and inclusive election. It must prioritise earning people’s trust.

অদৃশ্য কারণে বোর্ডসভা স্থগিত - নির্বাচনের আগে বিতর্কিত হতে চায় না কেন্দ্রীয় ব্যাংক

বাংলাদেশ ব্যাংকের পূর্বনির্ধারিত বোর্ডসভায় উপস্থিত থাকার কথা ছিল সব পরিচালকের। কিন্তু সকালের দিকেই অনেকে উপস্থিত থাকতে পারবেন না বলে জানিয়ে দেন। এতে স্থগিত হয়ে যায় গতকালের নির্ধারিত বোর্ডসভা। বাংলাদেশ ব্যাংকের বোর্ডসভা আকস্মিক স্থগিতে ঝুলে গেছে নতুন ব্যাংকের অনুমোদন। কারণ অন্যান্য বিভিন্ন বিষয় থাকলেও বোর্ডসভার মূল এজেন্ডা ছিল নতুন তিন ব্যাংকের অনুমোদন। নাম প্রকাশ না করার শর্তে বিভিন্ন সূত্র জানিয়েছে, নির্বাচনের আগে ব্যাংক অনুমোদন দিয়ে বিতর্কিত হতে চায় না কেন্দ্রীয় ব্যাংকও।

দেশের ব্যাংকিং খাতের নিয়ন্ত্রক সংস্থা কেন্দ্রীয় ব্যাংকের এ পর্ষদ সভা ঘিরে ব্যাপক কৌতূহল ছিল। কারণ এ সভাতেই নতুন তিনটি ব্যাংক অনুমোদনের কথা ছিল। ব্যতিক্রম কিছু না ঘটলে জাতীয় নির্বাচনের আগে বাংলাদেশ ব্যাংকের পর্ষদের সভা হওয়ার কোনো সম্ভাবনা নেই বলে জানিয়েছে কেন্দ্রীয় ব্যাংক সূত্র।

সূত্রগুলো বলছে, নির্বাচন কমিশন (ইসি) তফসিল ঘোষণা করায় রাজনৈতিক বিবেচনায় নতুন ব্যাংকের অনুমোদন দিয়ে বিতর্কিত হতে চাননি কেন্দ্রীয় ব্যাংকের কয়েকজন পরিচালক। এ কারণেই বোর্ডসভায় আগ্রহী হননি তারা।

বাংলাদেশ ব্যাংকের মুখপাত্র ও নির্বাহী পরিচালক মো. সিরাজুল ইসলাম বণিক বার্তাকে বলেন, পরিচালকদের কয়েকজন পর্ষদের সভায় উপস্থিত থাকতে না পারার কথা জানিয়ে দেন। এ কারণে পর্ষদের সভা স্থগিত করা হয়েছে। পর্ষদের পরবর্তী সভা কবে হবে, সে ব্যাপারে কোনো সিদ্ধান্ত হয়নি।

অনুমোদনের প্রক্রিয়ায় থাকা ব্যাংক তিনটি হলো— পিপলস ব্যাংক, বেঙ্গল কমার্শিয়াল ব্যাংক ও সিটিজেন ব্যাংক। ইসির আপত্তির পাশাপাশি প্রস্তাবিত ব্যাংকগুলোর প্রয়োজনীয় কাগজপত্রেও ঘাটতি রয়েছে। পর্ষদ সভা স্থগিতের পেছনে এটিও কাজ করেছে বলে জানা গেছে।

বাংলাদেশ ব্যাংকের পরিচালনা পর্ষদের একজন সদস্য বলেন, নতুন ব্যাংকগুলোর অনুমোদনের জন্য পর্ষদের এ সভাটি আহ্বান করা হয়েছিল। কিন্তু কাগজপত্র তৈরি না হওয়ায় পর্ষদের সভা আর হয়নি।

বাংলাদেশ ব্যাংকের গভর্নর ফজলে কবির পরিচালনা পর্ষদের চেয়ারম্যানের দায়িত্ব পালন করেন। পর্ষদের অন্য সদস্যরা হলেন— জাতীয় রাজস্ব বোর্ডের (এনবিআর) চেয়ারম্যান মো. মোশাররফ হোসেন ভুঁইয়া, আর্থিক প্রতিষ্ঠান বিভাগের সচিব মো. আসাদুল ইসলাম, অর্থ সচিব আব্দুর রউফ তালুকদার, বাংলাদেশ ব্যাংকের ডেপুটি গভর্নর এসএম মনিরুজ্জামান, বাংলাদেশ ইনস্টিটিউট অব ডেভেলপমেন্ট স্টাডিজের (বিআইডিএস) গবেষণা পরিচালক ড. রুশিদান ইসলাম রহমান, ইসলাম আফতাব কামরুল অ্যান্ড কোং চার্টার্ড অ্যাকাউন্ট্যান্টসের একেএম আফতাব উল ইসলাম এফসিএ এবং বাংলাদেশ অর্থনীতি সমিতির সাধারণ সম্পাদক ড. জামালউদ্দিন আহমেদ। এর মধ্যে এনবিআর চেয়ারম্যান মো. মোশাররফ হোসেন ভুঁইয়া গতকাল বিকাল ৫টায় আমেরিকার উদ্দেশে ঢাকা ত্যাগ করেন।

নতুন ব্যাংক অনুমোদনের বিষয়ে আপত্তি আছে বাংলাদেশ ব্যাংকেরও। কেন্দ্রীয় ব্যাংকের একাধিক কর্মকর্তা জানান, দেশের অর্থনীতির আকারের তুলনায় ব্যাংকের সংখ্যা এমনিতেই বেশি। গত ১০ বছরে অনুমোদন দেয়া হয়েছে ১২টি ব্যাংক। এর মধ্যে ১১টি বেসরকারি ব্যাংকের পরিস্থিতিই নাজুক। পরিচালকদের সম্পদের পরিমাণ, আয়ের উৎসসহ অন্যান্য বিষয়ে যথাযথ অনুসন্ধান না করেই ২০১৩ সালে নয়টি ব্যাংক অনুমোদন দেয়া হয়েছিল। এর মধ্যে ফারমার্স ব্যাংক বিপর্যয়ের শিকার হয়ে দেশের পুরো ব্যাংকিং খাতকেই বিপদে ফেলেছে। এজন্য নতুন ব্যাংক অনুমোদন দেয়ার ক্ষেত্রে বাড়তি সতর্কতার নীতিতে চলছে বাংলাদেশ ব্যাংক।

অনুমোদনের অপেক্ষায় থাকা পিপলস ব্যাংক লিমিটেডের উদ্যোক্তাদের কর-সংক্রান্ত তথ্য যাচাইয়ের জন্য ২২ নভেম্বর জাতীয় রাজস্ব বোর্ডের (এনবিআর) চেয়ারম্যানের কাছে বাংলাদেশ ব্যাংক থেকে চিঠি পাঠানো হয়। ব্যাংকিং প্রবিধি ও নীতি বিভাগের মহাব্যবস্থাপক আবু ফরাহ মো. নাছের স্বাক্ষরিত ওই চিঠিতে বলা হয়, গত ৩০ জুলাই ও ২৮ অক্টোবর-২০১৮ তারিখে আপনাদের পাঠানো পত্রে দেখা যায়, প্রস্তাবিত পিপলস ব্যাংক লিমিটেডের আটজন উদ্যোক্তা শেয়ারহোল্ডারের আয়কর-সংক্রান্ত মামলা অনিষ্পন্ন রয়েছে। প্রস্তাবিত ব্যাংকটি চলতি বছরের ৪ নভেম্বর এক পত্রের মাধ্যমে ওই আটজন উদ্যোক্তা শেয়ারহোল্ডারের মধ্যে আসলাম সেরনিয়াবাত ছাড়া অন্য সাত উদ্যোক্তা শেয়ারহোল্ডার বাদ দিয়ে নতুন চারজন উদ্যোক্তা শেয়ারহোল্ডারকে অন্তর্ভুক্ত করেছে। ব্যাংকটির ওই নতুন চারজন ও বিদ্যমান একজনসহ মোট পাঁচজন উদ্যোক্তার কর-সংক্রান্ত তথ্যাদি যাচাই করা প্রয়োজন। এ লক্ষ্যে প্রস্তাবিত ব্যাংকটির উদ্যোক্তাদের দাখিলকৃত পাঁচ সেট আয়কর বিবরণীর ফটোকপি আপনাদের বরাবর প্রেরণ করা হলো।

বাংলাদেশ ব্যাংকের পত্রে পিপলস ব্যাংকের উদ্যোক্তাদের দাখিলকৃত আয়কর বিবরণীতে প্রদর্শিত নিট সম্পদের পরিমাণের সঠিকতাসহ পাঁচটি বিষয়ে তথ্য চাওয়া হয়েছে। এ চিঠির উত্তর দিতে অন্তত দুই সপ্তাহ সময় নেবে এনবিআর। সে হিসেবে পিপলস ব্যাংকের উদ্যোক্তাদের সম্পদের তথ্য জানতেই চলতি বছর শেষ হয়ে যাবে বলে মনে করছেন সংশ্লিষ্টরা।

এ বিষয়ে পিপলস ব্যাংক লিমিটেডের আবেদনকারী এমএ কাশেম বণিক বার্তাকে বলেন, বাংলাদেশ ব্যাংক যেসব কাগজপত্র চেয়েছে, সেগুলো এরই মধ্যে সরবরাহ করা হয়েছে। অন্য কোনো বিষয়ে তিনি মন্তব্য করতে রাজি হননি।

অনুমোদনের অপেক্ষায় থাকা ব্যাংকগুলোর মধ্যে ‘বেঙ্গল কমার্শিয়াল ব্যাংক লিমিটেডের’ জন্য আবেদন করেন বেঙ্গল গ্রুপের ভাইস চেয়ারম্যান মো. জসিম উদ্দিন। যদিও শুরুতে ‘বাংলা ব্যাংক’ নামেই অনুমোদনের আবেদন জমা দেয়া হয়েছিল।

পিপলস ব্যাংক লিমিটেডের জন্য আবেদন করেছেন যুক্তরাষ্ট্র প্রবাসী আওয়ামী লীগ নেতা এমএ কাশেম। চট্টগ্রামের সন্দ্বীপের এ অধিবাসী যুক্তরাষ্ট্র আওয়ামী লীগের সহসভাপতির দায়িত্ব পালন করছেন। শরিয়াহভিত্তিক ব্যাংকিংয়ের জন্য ব্যাংকটির আবেদন করা হয়েছে।

সিটিজেন ব্যাংকের আবেদনটি এসেছে আইনমন্ত্রী আনিসুল হকের পরিবার থেকে। আনিসুল হকের মা জাহানারা হককে ব্যাংকটির চেয়ারম্যান হিসেবে উল্লেখ করা হয়েছে আবেদনপত্রে।

আইন সমানভাবে প্রয়োগ না করলে নির্বাচন প্রশ্নবিদ্ধ হবে

নির্বাচন কমিশনার মাহবুব তালুকদার বলেছেন, নিরপেক্ষভাবে আইনের প্রয়োগ না করলে সে আইন আইন নয়, সেটা কালো আইন। আইন সবার জন্য সমানভাবে প্রয়োগ না করলে সে নির্বাচন প্রশ্নবিদ্ধ হতে বাধ্য। নির্বাচন কমিশন কখনো তা চায় না। গতকাল নির্বাচন ভবনে নির্বাহী ম্যাজিস্ট্রেটদের এক ব্রিফিংয়ে বিশেষ অতিথির বক্তব্যে তিনি এসব কথা বলেন। একাদশ জাতীয় সংসদ নির্বাচন উপলক্ষে নির্বাচনী আচরণবিধি নিয়ে এক্সিকিউটিভ ম্যাজিস্ট্রেটদের উদ্দেশে এ ব্রিফ করে নির্বাচন কমিশন। ম্যাজিস্ট্রেটদের উদ্দেশে মাহবুব তালুকদার বলেন, একটা কথা বলা হচ্ছে, নির্বাচন আইনানুগ হতে হবে।

এই কথাটা অবশ্যই ব্যাখ্যার অবকাশ রাখে। কারণ আইনকে নিজস্ব পথে চলতে না দিলে, নির্বাচন কখনো আইনানুগ হতে পারে না। সুতরাং যখনই আমরা বলবো নির্বাচন আইনানুগ হতে হবে, তখনই তার সঙ্গে এটাও বলতে হবে, আইনকে তার নিজস্ব পথে চলতে দিতে হবে।

এটা করার দায়িত্ব আপনাদের। নির্বাচন কমিশনার মাহবুব তালুকদার আরো বলেন, আফ্রিকান একজন রাজা অভিনব কায়দায় বিচার করতেন। একটা গ্লাসে সরবত, একটাতে বিষ আরেকটাতে পানি রাখা হতো। দোষীরা আসতো। বিষ পান করলে মারা যেতো। পানি পান করলে অব্যাহতি পেতো। আর সরবত পান করলে পুরস্কৃত হতো। অনেকে তার বিচার ব্যবস্থা নিয়ে সমালোচনা করেছেন। 

উত্তরে রাজা বলেছিলেন, আমি তো রাজা, বিচারক নই। আমি তো বিচারের আইনকানুন কিছু জানি না। যিনি অপরাধী তার বিচার করেন ভাগ্য বিধাতা। আমি পুরোটাই ভাগ্য বিধাতার হাতে ছেড়ে দিয়েছি। কারণ এই বিচারে তিনিই আসল বিচারক। সেই রাজার বিচার ব্যবস্থা এখন আর নেই। এখন বিচারকরাই বিচার করে থাকেন। বিচারকরাই ভাগ্য বিধাতার প্রতিভূ। ম্যাজিস্ট্রেটদের উদ্দেশে তিনি আরো বলেন, আপনাদের (ম্যাজিস্ট্রেট) দায়িত্ব ও কর্তব্য সম্পর্কে বিশেষ কিছু বলার নেই। আপনারা সততা, আন্তরিকতা দিয়ে দায়িত্ব পালন করবেন। আইনের ব্যবহার সবার জন্য সমান হওয়া উচিত। 

মাহবুব তালুকদার বলেন, সুষ্ঠু নির্বাচনী ব্যবস্থাপনায় ম্যাজিস্ট্রেটদের দায়িত্ব অপরিসীম। শান্তি শৃঙ্খলা রক্ষায় পুলিশের পাশাপাশি ম্যাজিস্ট্রেটদের সমান দায়িত্ব। যারা নির্বাচন আচরণবিধি লঙ্ঘন করবেন তারা যারাই হোক না কেন, তাদের বিরুদ্ধে আপনারা কঠোর ব্যবস্থা গ্রহণ করবেন। জ্যেষ্ঠ এ নির্বাচন কমিশনার আরো বলেন, নির্বাচন কমিশনার হিসেবে আমরা শপথ গ্রহণ করলেও নির্বাচন সংশ্লিষ্টরাও আমাদের নির্বাচনী শপথের অংশীদার। শপথ আমরা গ্রহণ করলেও নির্বাচন আমরা করি না। নির্বাচন সংশ্লিষ্ট কর্তৃপক্ষ আপনারা (ম্যাজিস্ট্রেট)। আপনাদের মধ্যে শপথ সঞ্চালিত হয়ে যাচ্ছে। আগামী জাতীয় সংসদ নির্বাচন একটি অংশগ্রহণমূলক, পূর্ণাঙ্গ নির্বাচন হবে। আমরা অত্যন্ত ভাগ্যবান যে, সব রাজনৈতিক দল অংশ নিচ্ছে।

সারা জাতি এই নির্বাচন নিয়ে উদ্দীপ্ত, উচ্ছ্বসিত। এই উদ্দীপনাকে নির্বাচনের দিন পর্যন্ত ধরে রাখতে হবে। নির্বাচন অবশ্যই নিরপেক্ষ, সুষ্ঠু, অবাধ ও গ্রহণযোগ্য হতে হবে। এতে আপনাদের এক্সিকিউটিভ ম্যাজিস্ট্রেটদের দায়িত্ব অত্যন্ত গুরুত্বপূর্ণ। কারণ সেনাবাহিনীও আপনাদের অধীনে দায়িত্ব পালন করবে। শুধু দেশ নয়, বিশ্ববাসীও আমাদের জাতীয় নির্বাচনের দিকে তাকিয়ে আছে।

পর্যবেক্ষক নয়, বিশেষজ্ঞ পাঠিয়ে পরিস্থিতি মূল্যায়নে ইইউ

আসন্ন একাদশ জাতীয় সংসদ নির্বাচনে পর্যবেক্ষক না পাঠানোর সিদ্ধান্তে অটল ইউরোপীয় ইউনিয়ন। তবে ব্রাসেলস বাংলাদেশের ভোট পূর্ব ও উত্তর পরিস্থিতির ওপর তীক্ষ্ণ নজর রাখছে। ভোটের আগে বাংলাদেশের রাজনৈতিক পরিস্থিতি কেমন? তা সরজমিন পর্যবেক্ষণ, বিশ্লেষণ ও মূল্যায়নে প্রায় দেড় মাসের অফিসিয়াল সফরে কাল আসছে ইউরোপিয়ান ইউনিয়নের দুই সদস্যের নির্বাচন বিশেষজ্ঞ দল। ইইউ’র ভোট বিশেষজ্ঞ দলটি আগামী জানুয়ারি পর্যন্ত বাংলাদেশে থাকবে জানিয়ে দায়িত্বশীল একটি কূটনৈতিক সূত্র বলছে, সূচনাতে খানিক আনুষ্ঠানিকতা ছাড়া সফরের পুরো সময়ই বিশেষজ্ঞরা নীরবে তাদের পর্যবেক্ষণ ও মূল্যায়ন চালিয়ে যাবেন। 

তারা সরকার, নির্বাচন কমিশন, আদালত ও আইনশৃঙ্খলা বাহিনীর উচ্চপর্যায়ে বৈঠকাদি ছাড়াও স্টেক হোল্ডারদের সঙ্গে কথা বলবেন। এ নিয়ে সরকারের একজন কর্মকর্তা বলেন, এবারের নির্বাচন পর্যবেক্ষণে ইউরোপিয়ান ইউনিয়ন কোনো পর্যবেক্ষক পাঠাচ্ছে না। তবে ওই দুই বিশেষজ্ঞই ইইউ’র সদর দপ্তরে প্রতিনিধি হিসাবে ভোট পর্যন্ত বাংলাদেশে থাকবেন। এখানে তারা ‘নিঃশব্দে’ পরিস্থিতি মূল্যায়ন করবেন।

ভোটের পরিবেশ নিয়ে দূতাবাসের পাশাপাশি তারাও ব্রাসেলসে রিপোর্ট পাঠাবেন। বিশেষজ্ঞ দলের সফরটি খুবই তাৎপর্যপূর্ণ উল্লেখ করে ওই কর্মকর্তা বলেন, ঢাকা থেকে প্রাপ্ত রিপোর্ট বাংলাদেশের সঙ্গে ইইউ’র ভবিষ্যৎ সম্পর্কের ওপরে কিছুটা হলেও প্রভাব রাখবে। সরকারের এই কর্মকর্তা আরো বলেন, বিশেষজ্ঞরা জাতীয় নির্বাচনে কোনো নাক গলাবেন না এবং তারা জনসমক্ষে কোনো মন্তব্য করা থেকেও বিরত থাকবেন বলে আমাদের জানানো হয়েছে।

Khulna police 'snooping' on polls officials

'Accidentally' sends email, reveals looking into political leanings of election officials

A list of 74 probable polling officials along with their “political leanings” has been “accidentally” emailed by police to local reporters in Khulna.

According to the document sent on September 18 by Harintana Police Station along with a routine press release, only 11 of the 74 teachers are marked as BNP or Jamaat leaning and one as non-partisan while the rest are Awami League leaning.

The list further confirms that police have been collecting a host of personal information, including political leanings, about probable polling officials.

The Daily Star talked to four teachers tagged as BNP or Jamaat supporters in Khulna. All of them said they were dismayed, embarrassed and that their images had been tarnished by the act. They stressed that they were not involved with politics.

Headmaster of Rayermahal Hamidnagar Haji Mohsin Government Primary School, Mollah Tajuddin was marked as BNP leaning. “I have been working as a teacher for the last 25 years, but have never faced any question like this. I am a government servant and I have never been involved in politics,” he said.

The press release police intended to send to reporters was about the arrest of a suspected drug dealer with 115 bottles of Phensedyl.

The first page of the document contained the press release while the second and third pages contained a table containing the names, designations, workplaces, mobile phone numbers, and political leanings.

Names of assistant professors, lecturers, headmasters, senior assistant teachers, and assistant teachers of a college, a high school, and two primary schools appeared on the list.

According to the emailed document, the officer-in-charge of Harintana Police Station had sent the list of probable presiding officers, assistant presiding officers, and polling officers to the special superintendent of police of special branch of Khulna Metropolitan Police.

“With due respect and for your kind information, the names of the presiding officers, assistant presiding officers and polling officers have been given below in the chart,” the document quoted the OC.

Contacted yesterday, Nasim Khan, then OC of the police station and now with the Detective Branch, said he could not recall whether any such press release was sent.

Ashraful Alam, who is the OC now, said it was a mistake made before he joined.

Bibhuti Bhushan Mondol, assistant professor of Shaheed Abul Kashem College, was tagged as a BNP supporter. “The list has embarrassed me. My image is tarnished,” he told The Daily Star, adding that he had done many researches on Bangabandhu.

Assistant professor of the college, Sarder Rafiqul Islam was marked “Now a BNP supporter, used to support Jamaat”. He said had no idea as to how the list was made. He denied having any political leaning. Panchanan Golder, who was mentioned a BNP supporter, also said similar things.

Lecturer of the college Ruhul Amin, who was flagged a Jamaat supporter, said, “I was a custodian of the Tabligh-Jamaat at Rajshahi University. This list is not substantive,” he said, adding that people involved with Tabligh hardly ever support Jamaat.

In the wake of reports of police collecting information on probable polling officials, Chief Election Commissioner KM Nurul Huda on Thursday at a special meeting with law enforcers instructed police not to do that.

“We did not instruct you to do this. Don't do this. This is embarrassing,” he said.

EC failing to instil confidence of its neutrality

People's democratic rights are at stake

Political and security experts on Saturday expressed their discontent with the Election Commission, saying that its performance so far was not satisfactory. The EC has been granted immense power by the constitution and the credibility of the upcoming parliamentary election, no doubt, depends considerably on the actions of the commission.

Unfortunately, it has till now been reluctant to even respond to the complaints raised by opposition parties and has denied them the necessary space for effective campaigning and other political activities. Thousands of cases continue to be lodged daily against activists and politicians belonging to opposition parties, rendering them unable to effectively prepare for the elections as they remain increasingly occupied with fighting legal battles. Meanwhile, law enforcers have ceaselessly harassed and detained members of opposition parties in large numbers, as reported in the media, without the EC blinking an eye.

This is where one would have expected the EC to step in and demonstrate its ability to function without bias. However, by not doing so and by not giving opposition parties and their complaints a fair hearing, hasn't the EC already failed somewhat to maintain a neutral position? After all, any acceptable election requires that all stakeholders be given a chance to voice their opinions and concerns, and not simply be dismissed ungraciously by the commission. This includes concerns over the controversial introduction of electronic voting machines in the polls without adequate preparations.

As mentioned by experts, if this is the state of affairs during the pre-electoral phase, what can people expect during the election period? A free and fair election is the lifeblood of any democracy, and the people have already expressed their desire for a credible election. The EC should, therefore, exercise the immense power that it wields to ensure a level playing field for all, which is the only way to respect people's wishes.

Worrying attempt at legitimising extrajudicial killings

EXTRAJUDICIAL killing has worryingly become the norm. At least 437 people fell victim to extrajudicial killing by the law enforcement agencies and 26 others were forcibly disappeared in the past 10 months. It is not only that the extrajudicial killing is becoming rampant, such criminal acts on part of the law enforcement agencies also appear to have become legitimate to the people affiliated with the ruling party. Recently, the convener of the Kutubdia unit Sramik League, the ruling Awami League’s labour wing, in Cox’s Bazar has asked people allegedly involved in robbery and anti-social or anti-state activities in the locality to surrender to law enforcers or face ‘crossfire’. 

The convener, also a union council member, issued a public notice in this regard and sent it to imams of mosques in the locality for circulation. Contacted about the notice, he further elaborated on how he sees no wrong in acts of such killing. The public notice in question explicitly exposes the way ruling party leaders are approving and legitimising the death of the accused in the hands of law enforcement agencies although it is clearly defined as a punishable offence according to the Torture and Custodial Death (Prevention) Act 2013.

On many occasions, lawmakers are found to be justifying the killing of the accused without trial. In July 2017, Enamur Rahman, lawmaker for the Dhaka 19 constituency, came to be criticised when he told a newspaper how he maintains political control by threatening people in his constituencies with ‘crossfire’ death. He reportedly said that five people had been killed in ‘crossfire’ at his order and 14 more were on a list that he prepared. In the face of widespread criticism, the Awami League even considered an explanation from him. 

Earlier in September, at a public meeting, the minster for primary and mass education said the drug dealers should be killed in firing squads and that they do not deserve to live. Even a cursory review of these statements demonstrates the eschewed and fatally flawed legal values that they have internalised. It further reveals the unethical ties between the law enforcement agencies and lawmakers as the police or Rapid Action Battalion personnel often would take order from them or seek their help to fight crimes. It is evident that the political party in power, instead of taking steps to prevent extrajudicial killing, in effect, used it to maintain political control and suppress its political opponents.

During the past two national elections, the ruling party pledged that it would go by a zero-tolerance policy on extrajudicial killing. The fact that its members issue public notices approving and legitimising the moral failure and criminal misconduct of the members of the law enforcement agencies shows that the Awami League’s electoral pledge was rather rhetorical. Any party forming the government through the next national elections has to do more than rhetorical commitment to end extrajudicial killing.

Governance failure major risk to doing business in BD

Reveals World Economic Forum report

The failure of national governance becomes a major risk to doing business in Bangladesh and also in two other South Asian nations Nepal and Sri Lanka, according to a recent report released by the World Economic Forum (WEF).

The report titled 'Regional Risks for Doing Business' highlights 10 major risks to doing business in these countries.

"Political and economic concerns predominate among businesses in South Asia, with cyber-attacks also viewed as a concern," said the report.

The risks were identified after the global forum carried out an executive opinion survey during January-June period of the year. The findings were later tabulated with top five risks to five countries in South Asia- Bangladesh, India, Nepal, Pakistan and Sri Lanka.

By conducting the survey, the forum tries to look at the regional risks 'through the prism of the private sector'.

National governance failure is an issue. "This sentiment corresponds with a particularly busy political period in the region," the report said.

The national elections were held in Pakistan in July this year and Nepal in November and December last year. Another three are expected by the end of the year - in Bangladesh, Bhutan and the Maldives.

"The election process is often viewed with anxiety in South Asia as it can be accompanied by violence, blockades and other forms of political tension," observed WEF report. "Elections can also be followed by periods of uncertainty."

For Bangladesh, the 'energy price shock' is identified as top risk followed by national governance. Three other risks are: cyber-attacks, failure of regional and global governance and unemployment or underemployment.

The failure of regional and global governance featured most prominently in Nepal and Bangladesh.

Refugee and migration issues may be one driver of this, with approximately 700,000 people - mostly Rohingya - having fled from Myanmar to Bangladesh over the past year, noted the WEF report.

"In addition, India-Pakistan tensions remained ongoing in 2017, and there have been no bilateral talks between the two countries since 2015," it added.

The report said Bangladesh, Nepal and Pakistan are susceptible to cyber-attacks as "they continue to run on computers using Microsoft products that report malware encounters almost regularly."

The region's vulnerabilities came under spotlight after Bangladesh Bank was hit by hackers who got away with one of the biggest heists in the history, robbing the country's central bank of more than $80 million, said the report.

Private sector decision-makers in India and Pakistan, however, appeared more concerned by terrorist attack than national or regional governance failure.

Businesses in these two countries also identified water crisis as one of the top-five risks, which is also identified as a top risk in Pakistan.

The scope of this report, however, differs from the WEF flagship Global Risks Report, which presents a holistic assessment of the dangers facing the world. Regional report collects data from annual Executive Opinion Survey, which also provides input for the Global Competitiveness Report of the forum.

BB asks NBFIs to provide info about poll candidates

The central bank has asked non-banking financial institutions (NBFIs) to share information about default loans of the aspirants of the national elections, if any, with the returning officials.

The Bangladesh Bank (BB) issued a directive in this connection on Sunday, asking the managing directors (MDs) and chief executives of all the non-banks to comply with the instructions properly.

Talking to the FE, a BB senior official said the central bank has taken the measure to prevent any loan defaulter from contesting the parliamentary polls as per the electoral rules.

Under the existing rules, loan defaulters cannot participate in the national elections.

The officials of NBFIs have also been asked to collect necessary information on the aspirants from the returning officers, once the deadline for filling nomination paper ends on November 28, says the notification.

Besides, information about default loans will have to be provided to the returning officers on or before the day of scrutinising nomination papers, according to the notification.

The NBFIs officials have also been directed to be present at the offices of returning officers when nomination papers of candidates are scrutinised, if necessary.

The 11th national election is scheduled to be held on December 30.

Earlier on November 22, the central bank issued a similar directive and asked the MDs and chief executive officers of all banks to provide information about classified loans of the electoral candidates to the returning officials.

The BB has already taken preparations for providing information about default loans to the authorities through its Credit Information Bureau (CIB), according to the central bank officials.

The CIB was set up on August 18, 1992 in the central bank to minimise credit risks through reducing the volume of default loans.
