DISAPPEARANCE OF DR MOKHLES - HC asked IGP to take action against 3 cops

The High Court Division on Tuesday directed the Inspector General of Police to initiate departmental action against three police officers for their refusal to record complaints relating to disappearance of homeopathic doctor Sheikh Mokhlesur Rahman from the lock up of Satkhira sadar police.

The directive requires the IGP to take action against Emdadul Huq Sheikh, a former Satkhira Sadar police station officer-in-charge, his successor Firoz Hossain Mollah and Himel Hossain a former sub-inspector of the police station.

The court also asked Jesmin Nahar, wife of Mokhles, to file general diary with the Satkhira sadar police station or a complaint case with the magistrate’s court over the alleged disappearance of her husband from the lockup of the Satkhira police station, where he had been detained.

The doctor was arrested on August 4, 2016, and he simply vanished from the lock up of the police station during his detention. 

Jasmin Nahar met her husband in the lock up for three days when she took with her, homemade food for him. From the 4th day, she could no more meet her husband in the police station as he was not there in the lockup.

In the order, a bench of Justice Quazi Reza-Ul Hoque and Justice Mohammad Ullah directed the police to record Jesmin Nahar’s GD if she files it.

The court said it would pass further orders on February 25. On Tuesday, the court passed the order after hearing a probe report submitted by the Police Bureau of Investigation. The PBI report recommended departmental action against OCs Emdadul and Firoz and SI Himel and the other police officers of the Satkhira sadar police station.

The report said that the three named officers as well as the other officers of the police station showed extreme inefficiency and gross negligence by not recording the GD or a case following complaints that 27-year old physician Mokhles allegedly became victim of enforced disappearance by law enforcement agencies or others using their names.

The PBI, however, submitted that it found no evidence in support of Jasmin Nahar’s complaint that her husband had disappeared from the lockup of the Satkhira sadar police station or that she served him with home-made food in the lock-up over three consecutive days since August 4, 2016. 

A judicial inquiry report submitted to the High Country Division earlier found prima facie evidence of involvement of the then Satkhira police superintendent Altaf Hossain, OC Emdadul, SI Himel Hossain and higher police officials with the arrest of Mokhles and his subsequent disappearance from the lockup of Satkhira police station.

The judicial inquiry was conducted by Satkhira’s senior judicial magistrate Habibullah Mahmud following orders from the same bench.
On July 16, 2017, the bench ordered a fresh probe by the PBI, calling the judicial probe report as ‘controversial’. 

At Tuesday’s hearing, the bench expressed concern over the fact that no GD or case was recorded by the police though over two years passed since the disappearance of Dr Mokhles.

What’s the responsibility the police, asked the bench if the court has to give directives to record GDs or cases over the disappearance of citizens. The bench reprimanded the police for withdrawing Satkhira chief judicial magistrate’s gunman and holding probes against him instead of making efforts to find out Dr Mokhles as they were ordered to do.

In a writ petition Jasmin Nahar sought redress to her husband’s enforced disappearance from the police station’s lockup.

On the midnight of August 4, 2016, a police squad led by SI Himel had arrested Dr Mokhles at Satkhira New Market where he had gone to buy medicines for his father, she submitted in her writ petition. 


The judicial probe report found the authenticity in her statement.

Goom and limits of law enforcement in network capitalism

THE normalisation of goom as a common, everyday occurrence is more or less established. It means that at some point of time, people expect that goom will happen to someone. Very few people going by numbers do get goomed. But nobody is sure who that can be. Given the current pattern of goom, it is safe to say that this has been actively around for quite a while and what we are seeing is an acceleration of this activity, not a new one. It is as old as the republic itself. The question is why it has continued to be after all these years.

A look at the profile of the goomed shows a pattern. Many are political activists but not all. Small time thugs go missing too but are more crossfired. The attendant narrative has become so common that few even bother to ask. So whoever is responsible for goom remains a mystery but crossfire is simpler to understand. 

We tend to think that those goomed are anti-government or anti-state. Most think that they are picked up by some secret law enforcement agency and then kept in custody and in some cases are released. Those released then follow a similar pattern of failing to remember where they were, who the abductors were and so on. 

One can feel mystified by goom which is natural but an examination shows that it is a by-product of a systemic weakness of management of what the state considers to be crime. As far as the government and the state are concerned, it is all about law and order, not politics. Anti-state and anti-government politics is also perceived as criminal activities.









A quick class profile of goom

THE class element is a factor in determining the nature of goom and returning. For example, Aniruddha the businessman, Mubasshar the academic, Mizan the diplomat and the recently returned officials of the education ministry have the common signature of being well connected. 
Prior to that, children of two convicted war criminals were also goomed but they returned and went silent as per practice. But none went permanently missing. They all did return but to silence. 

It seems that the better networked do return but are chastened. The goomed from the middle networked return but not always. The fate of those from the low network is unknown to us. Those cross-fired also happen to be from this class. 

Hence, while every gooomed can be an enemy of the state, not everyone faces the same fate. But it is not politics and non-political crime, but those who threaten the state and those who do not. 

The absence of ransom demands is very important in this regard. Those who abduct have rarely asked for money and when they do have not followed it up. Hence, the cause of goom is generally attributed to a threat-lessening strategy. And it is at this juncture the various trends converge and diverge.

The jangi factor 

WHAT was a minor irritant before 1974 demised with the death of the major extremist Maoist Sarbahara Party. It returned as a major threat in 90s, went quite for long and again returned in the past decade. After a period of isolated killings, generally targeting those considered pro-secular/anti-Islamic, groups from within the jihadist cluster went for a big kill in the form of the Holey Artisan bakery attack. The rest is history. 

Now the counter-attack against jangibad, apparently successful, tells us about the threats to society as well. How the police and other law enforcers managed the situation is another matter but no matter how it happened, no questions were asked. The police action appeared to have public support and that is why the law enforcers felt they could do what they thought needed to be done, ignoring certain amount of media criticism.

In the process, the people also became part of the operations and people looked willing participants of that. The method would be closer to what is done in other developing states but not close to what is done in the developed world. 

Which is where the dilemma may lie.

The demands on a state law enforcement mechanism are very high, perhaps beyond its capacity which is forcing the state to deal with its threats through any means. Each threat is personal and, therefore, requires dramatic measures of survival.

Ill health of law and justice system

CONVENTIONAL law enforcement and justice delivery system have remained obsolete and investment in their development is negligible. But the perceived threats to the state and the system, whether political or systemic, have increased. The gap between the two is creating the space which allows all kinds of activities from mastani to goom, formal and informal, to survive.

This also allows the nature of wealth making that is in operation in Bangladesh — network capitalism — to flourish. It cannot function in a state of transparency and if the dominant economic system is not open, law enforcement and justice delivery will never be.

We have to learn to live with goom plus or let go the economic system which sustains the ruling class. Otherwise, goom will remain, even if the political identity of the victims changes in the years to come.

Attack on Sit-in - BCL men swoop on protesters

Bangladesh Chhatra League men yesterday (Tuesday) attacked dozens of Dhaka University students who were demonstrating in front of the vice-chancellor's office to press home a four-point demand, including expulsion of some BCL leaders for “harassing” female students a few days ago.    
                 
At least 50 students and two campus-based journalists were injured in the second such attack by the pro-Awami League student body in just eight days.

BCL General Secretary SM Jakir Hossain and its DU unit President Abid Al Hasan led the attack to “rescue” DU VC Prof Akhtaruzzaman, who was confined for around an hour in front of his office at the Registrar Building, demonstrators said.

Of the injured, 24 took treatment at Dhaka Medical College Hospital. One sustained brain injuries while three to four might have to be admitted there, said Sanaul Hoque Sarker, a doctor at the DMCH. 

 Several hundred BCL activists from almost all hall units and from other institutions took part in the attack, blocking all three gates of the building and beating up students at random with iron rods, cricket stumps and sticks, witnesses said.

Female BCL activists were seen beating up female students in different rooms.

"They surrounded us and attacked us from all sides without giving us any scope to speak," said Tajwar Mahmid Siam, a third-year student of mass communication and journalism.

However, BCL President Saifur Rahman Sohag denied that they swooped on agitating students. “On the contrary, the demonstrators attacked us when we went to rescue the vice-chancellor,” he told a press briefing last night at the Madhur Canteen.

The BCL also said leaders of different left-leaning organisations attacked them and harassed some of their female students. In a press release, the DU authorities also blamed the agitators for the episode, saying some “violent students and outsiders” besieged the VC's office.   

On January 11, students from different departments launched a protest, demanding that the DU cancel affiliation of seven colleges with it. Four days later, as part of their agitation, around 100 students staged a sit-in before the VC's office. But BCL men foiled their demo, allegedly after the VC called in the BCL men.

DU authority handed protester to police

They harassed the female students and assaulted Moshiur Rahman Sadik, coordinator of the protest. Later, the BCL men handed Sadik over to the university authorities who subsequently handed him over to the police.

On January 17, students under the banner of "Students against repression" started a fresh protest, demanding punishment of the BCL men for the assault. That day the agitating students broke down a gate of the Arts Building and kept the proctor confined inside his office for four hours. Later, the VC assured them of meeting their demands and formed a committee to investigate the January 15 incident.

The next day, the university authorities filed a case against 50 unnamed students for breaking down the gate and formed a committee to probe the incident, fuelling the protest.

"Beat us mercilessly"

Yesterday (Tuesday), the students first formed a human chain on the base of Aparajeyo Bangla and then brought out a procession on the campus to press home their four-point demand -- punishment of BCL men for the January 15 incident, withdrawal of the case, removal of the proctor for his alleged anti-student stance and solve the crisis over the affiliation of seven colleges.

Around 12:00pm, they besieged the VC's office after breaking down three gates -- the main entrance of the Registrar Building and two others inside. The VC was holding a meeting inside.

They wanted the VC to assure them of taking steps to meet their demands. But as he was leaving his office around 2:30pm without talking to the students, the protestors blocked his way, and placed their demands. The VC then assured them of taking action regarding the January 15 assault following due process, and said it would take time.

“All our activities will be conducted as per the University Ordinance of 1973. There will be no deviation from the rule of law,” he said.

The students insisted that the case be withdrawn and Proctor Prof AKM Golam Rabbani removed immediately. But the VC did not make any clear statement, and kept saying the same thing. The students kept him confined there. Then around 3:30pm, some 100 BCL leaders and activists led by Jakir and Abid came there.

As they tried to escort the VC away, a scuffle broke out between them and the agitating students. The BCL men, however, managed to take the VC inside his office and locked the gate of his room from outside.

In the meantime, several hundred BCL activists from different halls, and even from Dhaka College and Dhaka city units, joined in and took position around the building. As the agitators kept trying to get in touch with the VC, the BCL men launched the attack on them. Some students took shelter in several rooms in fear.

The agitators tried to leave the building, but the Chhatra League men caught them and beat them wherever they found, leaving many wounded. Two correspondents of this newspaper were present there.

Female BCL activists beat female students, torn dresses

Female Chhatra League activists, led by Fazilatunnesa Mujib Hall unit President Benjeer Hossain Nishi, Ruqiayyah Hall unit President BM Lipi Akter, Kuwait Moitri Hall unit President BM Farida Parvin and General Secretary Srabony Shaila were seen beating up female students and tearing up their dresses.

"They beat us mercilessly, irrespective of gender," said Meherunnahar Meghla, a student who became unconscious during the attack. As the BCL activists besieged the entire area, the protesters, especially female ones, could not leave the area and got beaten up.

The injured students include Masud Al Mahdi, Sezan Ahmed Jim, Abu Raihan, Sumaiya Arefin Orni, Anobik Onabil and Tunazeena Jahan.

Chhatra Union General Secretary Liton Nandi, Chhatra Union President of DU unit Tuhin Kanti Das, and Chhatra Federation President of DU unit Umme Habiba Benazir also suffered injuries.
Two DU Correspondents -- Mir Arshadul Haque of The Independent and Arifur Rahman of New Age -- were beaten up by BCL men of Jagannath Hall and Bangabandhu Hall. The two were covering the incident. Of them, Arshadul was admitted to DMCH in critical condition. Arifur took treatment at the DU Medical Centre.

Contacted for comment, VC's personal assistant picked up the call twice, saying, "Sir is in an important meeting."

Talking to the reporters after the incident, DU Proctor AKM Golam Rabbani said, "We will surely ensure punishment for the perpetrators based on evidence. No one will be spared."

In a press release, the DU authorities said some agitating students of the university and some outsiders launched a pre-planned attack in the name of demonstration.

Demonstrators, including some outsiders, took position in front of VC's office around 12:00pm, breaking down three gates with rods and cutters. They also chanted offensive slogans about the vice-chancellor, proctor and other teachers, it said.

Members of the proctorial team asked the agitators to send a delegation to the VC to discuss the issue but they did not pay any heed, and continued their violent activities, obstructing academic and administrative activities of the university, the release added.
At one stage, the agitating students barred the VC from joining a meeting of Board of Advanced Studies in front of his office.

"VC Prof Akhtaruzzman listened to their demands and assured them of taking steps after probing the incident and following due procedures, but the demonstrators rejected his assurance and continued hurling abusive words," it said.

"A group of teachers, university staff, officials and members of the proctorial body then rescued the VC from there by forming a human shield and took him to his office, when the protestors swooped on him." 

Terming the incident "pre-planned", the authorities sought help from teachers, students and journalists. The university authorities also formed a five-member committee to investigate the incident. The committee, headed by DU Treasurer Prof Kamal Uddin, was asked to submit its report as soon as possible.

Govt gloats over electricity amid outages, low voltage

A government survey has claimed to have found 86.9 per cent of the consumers satisfied with electricity supply when dissatisfaction with power outages and low voltage is widespread.

Unveiling the findings of the survey, carried out during off-peak season, officials on Monday at Bidyut Bhaban in the capital claimed that power supply in 2016-17 financial year was better compared with the previous six years.

Bangladesh Bureau of Statistics and Bangladesh Energy and Power Research Council jointly carried out the perception survey taking opinions of 9,927 consumers in October 2016 and 9,673 consumers in February 2017. Frequent power cuts and low voltage, however, cause severe public sufferings in six months from late March to early September, power distribution utility officials admitted.

Asked whether the survey reflected the reality with consumer sufferings in hot weather, power division secretary Ahmad Kaikaus said that the survey considered October as summer and February as winter. People in most of the rural areas in Rajshahi, Rangpur, Mymensingh, Barisal, Khulna and Chittagong divisions experienced frequent power cuts with acute low voltage problem in six months of 2017 from late March to September, New Age correspondents reported.

Low voltage, power cuts

Swapan Barman, rice processing yard owner at Durgapur in Netrakona, said that he experienced power cuts three to four times a day with low voltage problem which was severe during the past hot season until September.

Humayun Kabir, a farmer and resident at Babuganj in Barisal, said that they had experienced power cuts every one or one and a half hour during the past summer while frequency of power outages only eased in the current winter.

Jahidur Rahman, a residence of village Meramotpur of Charghat in Rajshahi, said that they were experiencing power cuts three to four times a day, which was hampering daily activities. They said that people continued experiencing power outages two to four times a day with low voltage even in the current winter — December and January.

In December, when power demand falls to one-third of summer demand, some 3,315 transformers burnt out as the mere lighting demand exceeded their capacities, according to a report prepared for power division’s monthly coordination meeting held on January 18.

The report also showed that 4,197 transformers were overloaded in meeting the winter demand, which would be five to six times higher in summer when the demand would go up for running fans and air conditioners, officials said.

Supply-demand mismatch

They claimed that the rural electrification was expanding faster than the expansion of distribution capacity, which was causing frequent power cuts and low voltage problem.

Rural Electrification Board chairman Moin Uddin said that the board had been providing new power connections at a rate of 3,00,000 to 3,50,000 per month which sometimes caused overloading. He said that they had built large stock of transformers to replace the overloaded ones while Kaikaus said that the government had taken initiatives to address the low voltage problem installing power plants in the country’s northern districts.

While addressing the report launching programme, prime minister’s energy adviser Tawfiq-e-Elahi Chowdhury said that the government now putting more emphasis on improving quality of electricity supply as a large number of new connections were provided.

Until December 2017, the Awami League-led government in nine consecutive years in office provided 16.8 million new power connections, 155 per cent of the total power consumers, until January 2009. The government, however, increased power transmission capacity by 2,631 line kilometres, hardly 33 per cent up from 7,991 line km, and distribution capacity by 159,631 line kim, 61 per cent up from 260,369 line km, over the same period of time.

The disparity between new connections and transmission and distribution capacities added to power cuts and low voltage problem.

The survey of BBS and research council showed that 11.20 per cent people were very satisfied, 45.80 per cent satisfied, 29.9 per cent moderately satisfied and 13.1 per cent not satisfied at all.

The interviewees through mobile phones responded to a question whether they were satisfied with the service or management of electricity supply.

In January 2015, the BBS also carried out another survey claiming that 89 per cent people were satisfied with power supply to households in 2014 compared to that of 2008 and 2009.

The survey findings drew severe criticism at that time as BBS collected data in January when the incidents of power cuts become negligible or have insignificant impact on common people.

SAVAR TANNERY ESTATE - 70pc machinery for central effluent treatment plant found substandard




Entire area is filled with stink as tanneries have been transferred to ill-equipped estate hastily, stakeholders say

The government made tanners in Hazaribagh shift to Savar Tannery Estate hastily, being misguided by a group of people about preparedness of the leather hub, said the BSCIC chief.

As industry stakeholders aired fear of local people's outrage against pollution by untreated tannery waste from the ill-equipped estate, the Bangladesh Small and Cottage Industries Corporation (BSCIC) Chairman, Mushtaq Hasan Muhuamad Iftikhar, came up with the accusation at a function Sunday.


The chief of the executing agency for the tannery hub on the western outskirts of the capital, Dhaka, also demanded punishment of those who are responsible for the situation.

The Savar Tannery Estate was not ready for operation when the tanners were made to relocate their factories over there last year, he said.

The BSCIC chairman wouldn't clarify who are the people responsible for relocation of the tanneries from the city to the suburb allegedly prematurely.

He was speaking at a seminar entitled 'Shifted tannery industry management and sustainable development'. Bangladesh Tanners Association (BTA) organised the seminar in the city.

Mr Mushtaq said they are working on the formation of a company for running the CETP (central effluent-treatment plant) and the estate after exit of Chinese construction company JLEPCL-DCL.

"We sent a proposal on a company to the ministry, we will begin official activities after getting approval," he told his audience from the leather industry.

The BSCIC chairman noted that tannery estate cannot recruit manpower as there is no option for new recruitment. The formation of a company is only solution for running the estate.

He disclosed that the government will build two new tannery estates in Rajshahi and Chittagong in view of potential growth in the sector in the regions.

He also said BSCIC sent detailed project proposal to the ministry for another 200-acre estate beside the existing one to accommodate backward- linkage sectors, smaller tanneries and other associated industries.

He said around 70 per cent machinery brought by JLEPCL-DCL for use in CETP has been found substandard and those will be returned.

He also said solid waste-based SPGS (Sludge Power Generation System) is not a sustainable option. There must be other ways for solid-waste management.

"We should think about other options for solid waste. Discussion for dumping solid waste into Amin Bazar landfill has not progressed much," he told the meet.

Speaking at the programme, BTA Chairman Shaheen Ahmed said many organisations are showing interest to use solid waste. There are many uses of tannery waste. If government allows them, the worry about solid waste will be gone.

He said the tanners ought to obtain certification and trust of foreign buyers for reaching $5 billion worth of leather-and leather-goods export by 2021.

He also said the tannery estate is still not fully functional for production. The CETP still releases polluted waters into the Dhaleswari River.

"The bad smell of solid waste is everywhere in the locality. River is getting polluted. If local people get angry, the things will really get out of hand," the industry leader said on a note of caution.

He said there is no school, hospital, accommodation for thousands of tannery workers. The government should ensure those basic needs for workers.

The Tannery Estate Project Director, Ziaul Haque, told the business meet that solid-waste management is a "great concern for us at this moment".

"Dhaka North City Corporation does not want to take tannery solid waste in their landfill; what we could do with solid waste now, we really don't know," he said.

He also said they had made many mistakes during development of estate for not having experience.

Professor of Civil Engineering at BUET Dr Delwar Hossain said tannery owners need training on proper management of liquid and solid waste.

He also asked estate authority to provide people to the Chinese company to get experience so that they can run the system after the contract is over.

Chairman of the Department at Development Studies at Dhaka University Dr Mohammad Abu Yusuf and leather expert Shikder Abu Naser, among others, also spoke at the programme.
